Terms & Conditions for Alberta

Upon commencement of this Service Agreement (the “Agreement”), Yardly (“the Contractor”) and the customer (“the Client”) agree as follows:

  1. 24-HOUR SATISFACTION GUARANTEE: Even though we take every measure to ensure your satisfaction with the initial service visit, if the Client finds any deficiencies, they must contact Yardly within twenty-four (24) hours of service completion. For clarity, “service completion” refers to the time at which the Yardly Pro departs the property. If you are unsatisfied with our service and the issue relates to work within the defined service scope, our Pro will return and address the concern free of charge. If deficiencies are reported beyond twenty-four (24) hours of completion, the issue will be addressed during the following scheduled service visit.
  1. SCOPE: Yardly will perform a service to all areas described in your Quote. The services will be performed on your property starting the 1st of APRIL 2025 and will end on 31st of OCTOBER 2025. The work shall be governed by the full terms and conditions of this Agreement.

Note: Availability of specific services and scheduling may vary by region within Alberta. Yardly will notify Clients of any regional limitations at the time of booking.

  1. EVENT DEFINITIONS: 
  • Rainfall Event: A Rainfall Event is defined as the accumulation of 3 mm or more of precipitation on the property. The event continues while rain accumulates and ends only when accumulation has ceased for at least three (3) consecutive hours.
  • Nuisance Event: A Nuisance Event includes any occurrence of measurable lightning, thunder, sleet, or rain under 3 mm. In the event of a dispute, Environment Canada records for the location nearest the property shall prevail.
  1. SERVICE DEFINITIONS: Spring, Summer, and Fall Services included in this Agreement are those listed in the Quote document.
  1. SERVICE SCHEDULES: 
  • Spring Services: April 1 – April 30
  • Summer Services: May 1 – September 30
  • Fall Services: October 1 – October 31

Recurring mowing visits will occur on a scheduled weekday. A $10/visit rescheduling fee applies. Skipped visits at the Client’s request will not result in a refund, as pricing is based on seasonal maintenance.

Spring/Mid-season/Fall Clean-Ups will be completed within three days of the scheduled date, subject to weather and ground conditions. Yardly prioritizes safety and scheduling efficiency across all service visits.

Note: The Client is paying for ongoing lawn maintenance, not time spent per visit. Shorter visits reflect the nature of maintenance cycles. There are no refunds for shorter visits.

  1. SERVICE NOTIFICATIONS: Yardly provides service-related updates via email and SMS/text message to keep Clients informed. Communications will be issued as follows:
  • An email will be sent on the weekend prior to the week of service to notify the Client that their property is scheduled for service during the upcoming week.
  • A second reminder email will be sent approximately 24 hours before the scheduled service, including preparation tips to help ensure successful completion of the visit.
  • If weather or unforeseen events delay the service, Yardly will issue additional email notifications with revised scheduling information.
  • A text message notification will be sent within approximately 15-30 minutes prior to the Yardly Contractor’s arrival.
  • Once service is completed, Yardly will send a follow-up text confirming completion, along with before-and-after photos of the property.

Clients are responsible for ensuring their contact information is current and accurate to receive these communications. Message and data rates may apply depending on the Client’s mobile service provider.

Clients acknowledge and consent to receive service-related text messages as part of this Agreement. These communications are transactional in nature and not promotional. Yardly complies with Canada’s Anti-Spam Legislation (CASL). Clients may update communication preferences at any time by contacting Yardly.

  1. INDIVIDUAL SERVICES: For single-season packages or individual services, the Client agrees to pay as per the Quote document, plus 5% GST, minus discounts. Services may be rescheduled due to weather events. There is no minimum charge for individual services.
  1. UNIVERSAL SERVICE PACKAGE CONDITIONS: In the event of three (3) or more consecutive days of rainfall, Yardly will complete the work as soon as possible. If rainfall continues for five (5) or more days, Yardly is not required to complete regularly scheduled work during that week. Yardly will monitor Environment Canada data to determine appropriate scheduling.

Clients must monitor their property and notify Yardly of any localized hazardous conditions. Clients agree to hold Yardly harmless for issues arising from failure to report such conditions.

  1. WEED CONTROL AND FERTILIZATION: Weed control applications may take up to ten (10) days to take effect. No guarantee is provided regarding full weed elimination. Complimentary reapplications are available after the 10-day window. Weed control does not apply to gardens, beds, or rock areas. Removal from these areas is available at $75/hour (2-hour minimum).
  1. PET WASTE COLLECTION SERVICES (Add-On Only): Pet Waste Collection is offered only as an add-on service in conjunction with Spring Clean-Up, Lawn Maintenance, or Fall Clean-Up. Clients must opt-in to this service in the Quote document. Yardly reserves the right to refuse or discontinue service in cases of repeated unsafe or excessive waste conditions.

Service Scope: 

  • Removal and bagging of pet feces from accessible turf areas, with secure disposal in the Client’s waste bin.
  • Available as part of one-time seasonal or recurring (weekly/bi-weekly) visits.
  • Pricing is based on number of dogs and visit frequency, as outlined in the Quote.

Client Responsibilities: 

  • Ensure pets are secured indoors or separately.
  • Gates and access points must be unlocked and unobstructed.
  • Waste should be solid and located in accessible, maintained turf areas.

Limitations & Exclusions: 

  • Yardly will not collect loose, diarrheal, or excessive waste.
  • Inaccessible areas (due to snow, overgrowth, ice, or obstructions) will be skipped.
  • Wild animal waste is excluded.
  • Excessive accumulation may result in added charges ($75/hour, 2-hour minimum) or service refusal.
  • Documentation may be used to support these decisions.

Missed or Rescheduled Visits: 

  • Visits affected by severe weather will be rescheduled without refund.
  • Client-related access issues (e.g., locked gates, loose pets) will result in skipped visits with no refund.
  • Return service may be requested at the standard hourly rate.

Health & Safety Disclaimer: Yardly does not provide sanitation services. Clients accept responsibility for maintaining a safe, sanitary yard between visits. Yardly disclaims liability for illness, injury, or adverse health outcomes related to pet waste, except in cases of gross negligence.

  1. SERVICE SPECIFICATIONS: Yardly will service areas up to 12″ from parked vehicles or obstructions. Clients must notify Yardly of adverse yard conditions and acknowledge that Yardly is not responsible for municipal debris or unsafe work environments.
  1. DELAYS: If Yardly is impeded by Client-controlled conditions (e.g., pet waste, vehicles, locked gates), the service affected will be skipped with no refund. Return visits will be billed at $75/hour with a 2-hour minimum.
  1. RETURN SERVICE CALLS: Clients must report service issues within 24 hours. Yardly will return within 24–72 hours at no charge if the work was incomplete per Yardly’s standards. If the work is deemed complete, a $100 service call fee applies.
  1. EXTRA SERVICE REQUESTS: Extra services must be requested in writing at least 12 hours in advance and will be billed at $75/hour (2-hour minimum). Yardly reserves the right to refuse extra work due to weather, safety, or availability.
  1. TREE & STUMP SERVICES: Yardly offers tree and hedge trimming, and tree and stump removal services, subject to availability in certain service areas. All such services require onsite access to complete an accurate Quote.
  • Quotes will be completed and provided to the Client within two (2) to four (4) business days of the request.
  • If the Client accepts the Quote, Yardly will schedule the work and complete the service within an additional three (3) to five (5) business days, subject to weather, resource availability, and seasonal demand.
  • Pricing, scope, and conditions for these services will be specified in the individual Quote. Yardly reserves the right to decline service where conditions are unsafe, restricted by municipal regulations, or outside the scope of Yardly’s capabilities.
  1. OVERGROWN GRASS: If grass exceeds 6” during the first or subsequent bi-weekly visits, a surcharge of $75/hour applies. Clients will be notified prior to the surcharge being applied.
  1. DEBRIS CLEANUP SERVICES: Spring/Fall Clean-Up includes removal of leaves, thatch, and small branches. It excludes dead annuals, cigarette butts, pinecones, needles, fruit, and large debris.
  1. INSURANCE: Yardly maintains $2,000,000 general liability and automobile insurance. Proof of insurance and WCB compliance are available upon request.
  1. LIABILITY: Yardly will perform work according to this Agreement and will repair damage caused by its actions. The Client waives claims for damage not caused by Yardly’s sole negligence and agrees to indemnify Yardly against liability for injury, illness, or third-party claims.
  1. FORCE MAJEURE: Yardly shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, extreme weather, government restrictions, or other force majeure events.
  1. PRIVACY: Yardly collects and uses Client information solely for the purpose of providing and managing services under this Agreement. Personal information will be handled in accordance with applicable privacy legislation including the Personal Information Protection Act (Alberta) or PIPEDA as applicable.
  1. PAYMENT TERMS: Payments must follow the schedule in the Quote. Monthly Clients are billed on the first of each month. Seasonal and recurring services are charged a 10% deposit at booking if booking is completed prior to season commencing. If booking is made in-season, the full amount for one-time services (spring/fall cleanup) are charged in full, which also includes the first month of any recurring services. Clients may opt to pay for the entirety of their services in full if requested. Services will be suspended automatically for accounts overdue by more than seven (7) days.
  1. SENIOR DISCOUNT: Yardly offers a 10% discount on eligible services for Clients 65 years of age or older. This discount is applied at the time of booking and may require proof of age upon request. The discount is intended exclusively for seniors and cannot be transferred or applied retroactively. Yardly reserves the right to verify eligibility and revoke the discount if used inappropriately.
  1. AUTOMATIC RENEWAL OF SERVICES: Unless otherwise stated in writing, all seasonal service packages, individual services, or service combinations purchased under this Agreement will automatically renew for the next service season on substantially similar terms. Yardly will provide a notice of upcoming renewal via email at least thirty (30) days prior to the end of the current service term. If the Client does not wish to renew, they must contact Yardly by phone or email no later than fourteen (14) days prior to the scheduled start of the next service term. Continued use of services after the renewal date constitutes acceptance of the renewed Agreement. Yardly reserves the right to adjust pricing or terms at the time of renewal, and such changes will be clearly communicated in advance. The Client is responsible for keeping contact information up to date to ensure timely receipt of renewal notices.

Clients must uncheck this box to opt out of renewal. Clients who leave the box checked provide affirmative consent to renewal under the terms of this Agreement.

  1. CANCELLATION & TERMINATION: Clients may terminate with 7 days written notice and opportunity for Yardly to resolve issues. For one-time services, a $50 administrative fee applies to cancellations made within 72 hours of booking. Refunds may be prorated, and discounts forfeited for early cancellations. This Agreement is subject to the Consumer Protection Act (Alberta). Nothing in this Agreement limits your statutory rights.
  1. DISPUTE RESOLUTION: In the event of a dispute that cannot be resolved through direct communication, the parties agree to submit the dispute to mediation in Alberta prior to initiating formal legal proceedings. This Agreement shall be governed by the laws of the Province of Alberta.
  1. INTEGRATION & SEVERABILITY: This Agreement supersedes all prior discussions. If any provision is found unenforceable, the remainder shall remain in full force and effect.
